Terms of Use and
End User License Agreement

These Terms of Use and End User License Agreement (this "Agreement") are entered into between Fırat Erol, an individual developer ("Developer," "we," "us") and you ("User," "you"), the user of the NailInspo mobile application (the "App").

1. What the App Does

The App allows you to upload photos of your own hands and generate AI-assisted nail art visualizations. It also offers a curated theme catalog, a trending design feed, and the ability to view designs that other users have chosen to share.

The App is not a cosmetic, health, or medical service. The images it produces are for visualization and inspiration only and do not guarantee the outcome of an actual manicure.

2. License Grant

Subject to your compliance with this Agreement, we grant you a personal, non-transferable, non-exclusive, non-sublicensable, revocable license to use the App on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service.

You may not:

• Copy, reproduce, sell, rent, lease, or sublicense the App;
• Reverse engineer, decompile, disassemble, or create derivative works from the App;
• Circumvent security measures, rate limits, or subscription controls;
• Access our API with automated tools (bots, scrapers) without our permission;
• Use the App for any unlawful purpose or in any way that infringes the rights of others.

3. Your Profile and Eligibility

• You must be at least 18 years old to use the App.
• Your profile is created automatically and is linked to your Apple ID through iCloud. There is no password.
• Anyone who can use your iPhone or your Apple ID can use your profile. You are responsible for keeping them secure and for all activity under your profile.
• You must notify us immediately if you suspect unauthorized use of your account.
• One account is created per device. You may not transfer your account to anyone else.

4. Content You Upload

4.1 What you may upload

You may upload only photos of your own hands. For every image you upload, you represent and warrant that:

• The image belongs to you, or you hold all rights necessary to upload it;
• The person shown in the image is you;
• The image does not infringe any third party's intellectual property, privacy, or personality rights.

4.2 Prohibited content

You are strictly prohibited from uploading:

• Obscene, pornographic, or sexually explicit imagery;
• Violence, blood, injury, or otherwise disturbing content;
• Photos of other people without their consent;
• Images of minors;
• Hate speech, discriminatory, or harassing material.

4.3 Rights in your content

You own the photos you upload and the designs you generate. You grant us only the limited rights necessary for us to provide the service: to process, store, and transmit your image to our AI providers (fal.ai and Google Gemini).

If you choose to make a design public, you permit that design to be shown to other users in the App's discovery feeds. You may revoke this at any time — turning visibility off removes the design from those feeds.

Your original hand photos are never shown to other users. A generated design shows your hand; it stays private unless you make it public yourself.

5. Subscription and Payment

5.1 Automatic renewal

• Payment is charged to your Apple ID account upon confirmation of purchase.
• Your subscription renews automatically unless you cancel it at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel your subscription in iOS Settings → Apple ID → Subscriptions.
• Cancellation takes effect at the end of the current period. No refunds are provided for the unused portion of a current period.

5.2 Free trial

Where a free trial is offered, any unused portion of the trial is forfeited when you purchase a paid subscription. If you do not cancel at least 24 hours before the trial ends, it converts automatically into a paid subscription.

5.3 What your subscription unlocks

An active subscription is the only requirement for using the AI generation features. There are no credits, tokens, quotas, or per-design charges.

• While your subscription is active, you may generate designs without a usage cap;
• Access ends when your subscription lapses, is canceled, or your account is closed;
• To protect the service, requests are subject to a technical rate limit (currently 10 requests per minute). This is an abuse-prevention measure, not a usage allowance.

5.4 Refunds

All purchases are made through the Apple App Store and are subject to Apple's refund policy. Refund requests must be submitted directly to Apple at reportaproblem.apple.com. We are not able to issue refunds directly.

5.5 Price changes

We reserve the right to change subscription prices. You will be notified before any increase takes effect and, where Apple requires it, asked to consent. If you do not accept the new price, you may cancel your subscription.

6. AI Processing Disclosure

The accuracy, quality, or suitability of AI-generated results is not guaranteed. Generated images do not represent the outcome of a real manicure.

7. Acceptable Use

When using the App, you agree not to:

• Send automated requests that overload our systems;
• Attempt to access other users' accounts;
• Probe for or exploit security vulnerabilities (except under an authorized security test);
• Reverse engineer the App or use it to build a competing product;
• Harass other users or share disturbing content.

7.1 Zero tolerance for objectionable content

There is no tolerance for objectionable content or abusive users. You may not make public any content that is sexual, violent, hateful, harassing, discriminatory, illegal, or that infringes someone else's rights or privacy.

• Report: every public design has a "Report" option. Reported content is reviewed within 24 hours, and content reported by several users is removed from public feeds automatically until it is reviewed.
• Block: you can block any user; their content disappears from your feeds immediately.
• Enforcement: we remove content that breaks these rules and suspend or terminate the accounts that posted it.

8. Intellectual Property

The App, its design, interface, logos, theme catalog, and all software components are owned by Fırat Erol and protected by intellectual property law. This Agreement grants you no ownership rights in the App.

9. Service Availability

We provide the App "as is" and "as available." We do not warrant that it will operate uninterrupted, error-free, or secure. We may suspend the service temporarily for maintenance, updates, or technical necessity.

10. Limitation of Liability

To the maximum extent permitted by applicable law, the Developer is not liable for indirect, incidental, special, or consequential damages, loss of profits, or loss of data. In all cases, the Developer's total liability is limited to the amount you paid for the App during the 12 months preceding the claim.

This limitation does not affect statutory consumer rights that cannot be limited by contract.

11. Termination

You may terminate this Agreement at any time by deleting your account. We may suspend or terminate your account if you breach this Agreement. When your account is closed, your data is deleted within the periods stated in our Privacy Policy.

12. Governing Law and Jurisdiction

This Agreement is governed by the laws of the Republic of Türkiye. The courts and enforcement offices of the Republic of Türkiye shall have jurisdiction. As a consumer, you retain the right to bring proceedings before the consumer arbitration committees and consumer courts of your place of residence.

13. Apple-Specific Terms

The following terms apply to the version of the App obtained through the App Store:

• This Agreement is between you and the Developer only; Apple is not a party to it.
• The Developer alone is responsible for the App, its content, maintenance, and support. Apple has no obligation to provide support.
• If the App fails to conform to any applicable warranty, Apple may refund the purchase price. Beyond that, Apple has no warranty obligation whatsoever.
• The Developer is responsible for product liability claims, compliance with consumer protection law, and addressing any claims of intellectual property infringement.
• You represent that you are not located in a country subject to a U.S. Government embargo and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of this Agreement and have the right to enforce it against you.

14. Changes to This Agreement

We may update this Agreement. We will notify you of material changes through an in-app notice or by email. Continuing to use the App after a change takes effect means you accept the updated Agreement.
